Clinical Negligence – Misdiagnosis Claims

Misdiagnosis claims

When making a claim for clinical negligence is relation to a misdiagnosis, there are three categories that it can come under; missed misdiagnosis, wrongful misdiagnosis and delayed misdiagnosis.

Missed Diagnosis

A missed diagnosis is when a patient has an existing illness or condition and the medical practitioner fails to recognise the symptoms of this. If a medical practitioner fails to spot symptoms of an illness then they will not give the patient a diagnosis which ultimately will result in the patient not receiving the necessary treatment which can prolong treatment and recovery time.

Wrongful Diagnosis

A wrongful diagnosis can be when symptoms have been wrongly identified and linked to a condition or illness the patient doesn’t actually have. This can result in the patient undergoing unnecessary treatment. In other cases of wrongful diagnosis the patient may be receiving treatment for the wrong diagnosis while their actual condition is still being left untreated which can result in them requiring more extensive treatment when their actual condition is identified.

Delayed Diagnosis

If a patients symptoms are not diagnosed in time it can result in their condition progressing to an advanced stage, resulting in unnecessary suffering, longer recovery time and in some cases it can even impact on the patient’s life expectancy.

A few examples of common cosmetic surgery procedures in the UK include:

  • Breast Enlargement or Augmentation Surgery
  • Blepharoplasty (eyelid surgery)
  • Abdominoplasty (tummy tuck)
  • Rhinoplasty (nose reshaping)
  • Liposuction

If cosmetic surgery goes wrong the patient can be left with devastating results, especially if the surgery is to their face, nose or breasts. Cosmetic surgery negligence can leave the patient with injuries, pain and distress. Illness caused by infections or rejections of tissue or implants. Patients can also be left with deformities such as scarring, misshaping or a lack of symmetry which may require further surgery to correct.
