Funding Your Claim.
You know that you have a case, but how can you afford to pay a solicitor?
To provide you with peace of mind, we recommend that all claims are dealt with on a No Win No Fee basis and combined with an After the Event (ATE) insurance policy or a suitable Before the Event (BTE) policy, if you have one. If your claim is unsuccessful, the ATE policy will meet the cost of the expenses typically incurred as part of the cost of bringing a claim. If your claim is successful, the policy will protect you from the risk of paying your opponent’s costs that comes as part of rejecting formal attempts to settle your claim made by your opponent. The ATE premium is deferred. That is, it is only payable at the conclusion of your claim and only then, if your claim is successful.
The Key Benefits of this approach are:
- There is nothing for you to pay upfront;
- We will fund any expenses which are required to be paid on your behalf until the conclusion of the claim;
- Provided you comply with the terms of the No Win No Fee Agreement and our own Terms and Conditions; there should be nothing for you to pay if you lose
- If you are successful, the contribution to the costs of the claim will be capped at no more than 25% of your compensation (10% for children), plus the cost of any after the event insurance.
Please call us if you would like to discuss the benefits of this arrangement in more detail.
What happens now?
To ensure you are protected, we will take out the ATE policy on your behalf as soon as our completed agreements are returned. In the meantime, please check whether you already have a legal expense policy which might protect you from the risks detailed above. If so, please contact us with full details so that we can make enquiries with the insurer on your behalf.
