Let’s dissect the term before we give it a proper definition. “Vicarious” means something that is experienced by somebody else rather than it being yourself. “Liability” means that you are meant to be responsible or ”at fault”. Putting the two together then means the person who actually inflicted the harm may not actually be the one who is at fault. If the employee is acting on the instruction of a higher authority, the liability of the accident will fall on them.

So, let’s put it a little more simply now that we’ve described what it is all about. Vicarious Liability means that the employer is actual liable for damages because their employers (and their actions) give the instructions and are responsible for any hazards that are not marked out and put right.

Normally, if you are going to be eligible for work accident compensation, you need to prove that you were not at fault for your injuries. It is the responsibility of your employer to provide a safe work environment. However, if:

  • Neither you nor your colleagues received proper training
  • You and your colleagues are asked to carry out inappropriate tasks (i.e. carrying heavy boxes)
  • Both you and your colleagues are not allowed to take proper breaks
  • None of the environmental hazards in your workplace have been marked out (i.e. puddles)
  • You and your colleagues were told to use faulty/damaged equipment

Therefore, if your colleagues cause you damages that are beyond the control of either of you (i.e. by dropping something on you or spilling something), it is the responsibility of the employer to pay compensation.

Every work accident injury is completely different. You have to realize that different injuries will lead to different forms of compensation. If you have been seriously hurt due to your accident, your colleague could claim third-party damages due to emotional or psychological trauma. However, this sort of compensation does depend on whether they fall into certain criteria (i.e. if they witnessed your accident or if they are a very close family member, friend or loved one). According to David D’Souza, from the Chartered Institute of Personnel and Development, he has listened to the complaints of people being forced to go back to work by their employer and believes that it is:

”Of huge concerns in terms of people’s physical and mental well being…Any return to work should only be done if these criteria are met: It’s necessary, it’s safe and it’s mutually agreed.”

It is up to you to decide how you feel about returning to work. If you are worried about catching Covid-19, you will need to discuss this with your employer. That way you can get an outcome that would suit your situation.

Accident at Work: Forklift Truck

Today, we talk about a Accident at Work that could happen to anyone. A member of staff at a logistics firm had her life changed forever after an incident with a Forklift truck.

The warehouse did not have sufficient segregation between forklifts and pedestrians which meant a forklift was able to cross onto a pedestrian pathway causing a life-changing injury to the staff members leg.

The staff member was rushed to hospital where surgeons tried to save their leg but their foot had to be amputated. Over the next few months this injury required further operations on their leg, eventually meaning a further amputation.

In the UK, up to five people a day have a life-changing injury caused by Forklift Trucks ranging from loss of life, amputation and broken bones.

Workplace Accident: Man Loses Fingers

A Workplace Accident can change lives

A terrible workplace accident occurred at a  decorative panel manufacturing company. The business was fined after a worker was injured when using an industrial saw.

Leeds Magistrates’ Court heard how, in March 2016, an employee of an industrial cutting company was working alongside colleagues using a beam saw to cut sheets of MDF. When he reached into a hole in the fixed guarding, which he believed was a viewing hole, to clear waste offcuts, his fingers became trapped under a drive chain and sprocket. As he pulled his hand out, three fingers were severed.

An investigation found that, while suitable guarding was in place on other areas of the machine, the company had failed to identify the hazard posed by the open hole where access to the dangerous moving parts was possible and injury could be caused.

The company was found to have breached the code of practice for the safe use of machinery in the workplace and was ordered to pay costs of £45,859.
