What are the signs that you have been mis-sold your pension?

Why did my PPI pay-out get taxed in the first place?

One of the latest claims that we have been working on for our clients over the last year are PPI tax claims. So far we have managed to claim around £10,000 in total for our clients over the last year. However, you may be wondering why your PPI pay-out had tax taken away from it in the first place.

Originally, PPI was used as a safety blanket for those who took out financial loans and could not pay the money back. But in most cases the policy was mis-sold, therefore the UK public received a pay-out from HMRC. This pay-out consisted of:

  • The payments for your PPI
  • Any interest that was added onto the PPI payments from your bank
  • A statutory interest of 8% per year

The pay-out was used to get you back to what you should have financially been at before you were forced to pay PPI. However, if it was suspected that you went over your personal savings allowance (PSA), your statutory interest may have been taxed. Unfortunately, this may have been an incorrect assessment, and tax could have been deducted by mistake, or it could have been automatically deducted at 20%.

Will my job change affect my marriage tax claim?

Another tax claim that we have been focused on are marriage tax claims. Did you know that 50% of married couples and civil partners are eligible for a marriage tax, but just don’t know about it? Can I still make an accident at work claim if I am now working remotely?

Nowadays, as the majority of our UK clients have been remotely working since the start of the pandemic, if they have previously suffered an accident at work (for instance in the work environment), then they may not feel comfortable enough to move forward with their claim.

Before we jump into whether or not your job will affect your marriage tax claim, let’s have a brief discussion about the basics of the claim itself. Marriage tax claims are also known as a tax break. Throughout your lives, you and your partner are going to be paying tax each year for public services, any businesses that you own and any additional welfare projects. A marriage tax claim will allow you to transfer over a small portion of your personal savings allowance to your partner (or vice versa) to receive a discount on the tax you pay. It may also entitle you to a refund of any excess tax that you (or your partner) has paid over the last few years.

Before we jump into whether or not your job could affect your marriage tax claim, there is one more thing we need to cover. That is your eligibility to have a successful tax break. There are three criteria that you need to fulfil if you are going have a claim. Keep in mind that you will need to be able to say yes to each of the criteria if you are going to have a valid claim. This includes paying a certain amount of tax.

As you can see, the tax you pay does play a big part in whether or not you could make a valid tax claim. The reason why you and your partner need to either pay no tax or basic tax is due to the fact that a PSA transfer needs to happen. The lower earner will most likely have an excess allowance that can be transferred to the basic tax payer, who has not gone over their allowance. The transfer will allow the higher earner to get a discount on their tax. They will even be allowed to backdate their claim for up to 4 years. One thing that could happen in the new year is that the UK could join the Lugano Convention. This convention is similar to the Brussels I Regulation. In special circumstances, you will be allowed to bring abroad cases in the EU back to the UK to have the proceedings decided on. Another thing that could happen is that the UK could sign a bilateral treaty. This would mean that the UK could still have the same rights as the EU when it comes to certain legislation (such as motor insurance). However, all of this is yet to be decided. Just keep it in mind over the upcoming months if you have started on a personal injury claim.

For the last year, Gowing Law has been working tirelessly to get our clients a successful PPI tax claim where they can get their money returned from HMRC. However, now that 2021 has rolled around, you may be worried about whether or not you could be eligible to make a PPI tax claim yourself. All tax claims have a limit on them. Whether you are looking to claim back the tax on your PPI or you are interested in making a marriage tax claim, you should have around 4 years from the previous tax year from when the over-payment occurred. Am I eligible to make a PPI Tax Claim in general?

To understand whether or not you are eligible to make a PPI tax claim, you need to know about the background of PPI claims in general. PPI stands for “payment protection insurance.” Originally, it was used as a safety net for those taking out financial payment schemes. This included credit cards, lending schemes and catalogue payment plans. If you got ill or did not have the money to pay back what you owed, your PPI would be able to cover you until you got the funds needed to clear your debt.

However, in the majority of cases, the PPI scheme did not provide enough money to cover the payments. In fact, in most cases it was simply mis-sold. Most people:

  • Did not realize they were sold PPI
  • Were pressurized into buying a PPI plan
  • Had the plan inserted into their payment policy without being told
  • Received a policy that did not suit their financial needs (i.e. they were self-employed or were working abroad.)

These mis-sold policies usually meant that people were losing more money that they realized. That is why the government allowed people to reclaim this money that they had lost by purchasing a PPI policy. The problem came from the fact that HMRC issued a refund but took away tax, meaning that clients did not get the full amount they were owed.   • The amount you paid for your PPI
  • Any additional interest that was added to your PPI payments
  • A tax of statutory interest that wad added at 8% every year to both the PPI payments and PPI payment interest

The pay-out you received was supposed to help you get back to the original amount you were at. However, if you did not go over your personal savings allowance (PSA), then the bank may have automatically taken away tax without realizing you did not go over your limit. Only your statutory interest can be taxed. That’s why 20% of your payment may have been taken away. However, you can claim this back with the help of one Gowing Law’s tax specialists.

  • Top Rate Payers: If you pay around 45% in tax, you are not eligible for a PPI tax claim.
  • High Rate Payers: If you pay around 40% in tax, you could claim around £500, tax-free.
  • Basic Rate Payers: If you pay around 20% in tax, you could claim around £1,000, tax free.

Even if you have been rejected before for a PPI tax claim by HMRC, you could be owed money that you will need a solicitor to help you claim back. A solicitor can help you estimate how much you could be owed and how you can quickly get your payment back. Just keep in mind that it may take a little longer due to the current UK court backlog.
