Comfortable Christmas: Housing Disrepairs & Insect Infestation

Housing Disrepairs Header

Housing Disrepairs can happen any time of the year. However, the last thing you want at Christmas time is an uninvited guest. Damages to your home can come in many shapes and sizes. However, there are some that can come in swarms and can leave destruction all over your home. An insect infestation can leave gaps in the external and internal walls of your house and can also spread disease by burying into your food and defecating in your cupboards.

Your landlord should ensure that your house is in a habitable state. That way you and your family can live in it comfortably without there being any illness or breezes let in through cracks and splits in the walling. If your landlord refuses to help with any insect infestation, it’s time to get started on a Housing Disrepair Claim. Gowing Law Solicitors can help.

Christmas is a time for you to relax and unwind. We want you to have a cosy Christmas. That’s why we are determined to help you get the compensation that you deserve. You don’t deserve to live with an insect infestation. We can help you get started with your claim. The basics of Housing Disrepairs

Housing disrepair claims are there to protect you if your home is suffering from damages that have not been fixed by your landlord. When you sign a contract with your landlord for a council house or home from the housing association, they have a responsibility to ensure that the repairs are sorted out as quickly as possible. That way you won’t fall into any harm or experience damages whilst you are living in the property. Of course, there are times when damages may occur which are completely outside of their control. Therefore, you will need to inform them as quickly as possible about them. A notice period of a month will then take place whilst they try and figure out what repair work you will need.

You should follow this process to ensure that your repairs are sorted out as quickly as possible:

Housing Disrepairs Help

Of course, not all landlords may take your housing disrepair issues seriously. If you experience this then this is an act of negligence. If you end up getting hurt due to the damages, or your belongings are destroyed due to the disrepairs, they could be liable for paying you compensation. Examples of this negligence can include:

  • Being completely ignored by your landlord
  • Your landlord becomes aggressive with you
  • The disrepairs are fixed cheaply by your landlord and they cause further damages
  • Your landlord demands that you pay for the damages

If any of these acts of negligence happen to you, you could be eligible for compensation. All you need to do is get started on your compensation claim with Gowing Law Solicitors. Our specialists will work on your behalf to ensure you get the pay-out that you deserve.

Will I be eligible if I caused the damages in my house?

Housing Disrepairs: What sort of insects could invade my home?

Insects are more likely to infest your home during the winter times. As we get closer to Christmas, you may put away food and drink to keep for the holidays for you and your family. If there are cracks, wide crevices or exposures to the outside world, it’s likely that insects will come into your house for shelter and warmth. They may also come in if they smell food. Any pestilence can potentially spread diseases and cause general discomfort within your home. However, bugs can cause infections that you may need to go to hospital to get treatment to sort.

The type of insects that could infest your home include:

  • Bed bugs
  • Ants
  • Cockroaches
  • Slugs
  • Spiders
  • Flies
  • Hornets
  • Wasps
  • Fleas

Of course, these are only a few examples of the types of insects in your home. Children and the elderly are mostly susceptible to these house invaders. This is due to the fact that they are more likely to get ill or suffer from an infection when they are bitten. Insects carry diseases that can get worse if they are left untreated. Keep an eye out for bites or discoloration of the skin. This may be an indication that you have been bitten. You should also keep an eye out for nests and eggs. Spiders keep their eggs in sacks and they can burst and cause a number of baby spiders to infest your house. Make sure to avoid this at all costs!

Housing Disrepairs: Mould, Damp & Insect Infestation

It’s important to understand that if you do end up having an insect infestation, it is likely because you are also experiencing mould and damp issues. Insects are attracted to mould and damp. Therefore, if there is any in your house, you may notice flies or bugs moving up and down the infected areas. Make sure to use special chemicals or sprays to try and remove the mould. If you dry the patch out, you may be able to lessen the impact of the mould.

You may also notice that the insects attempt to make their nests around the mould. To get rid of them, you may need to get a specialist (such as a fumigator) to visit your house to inspect the area. At the same time, you may need to leave the property to make sure that you are safe and do not inhale or touch any nasty chemicals.

Housing Disrepairs: How do I know that I have an insect infestation or pests in my house?

Whether you have just moved into your council house, or have been in your council home for a very long time, there are some signs to keep an eye out for if you are experiencing a pest problem. For creatures like rats, mice, bats and other non-insect, you may find droppings or evidence of a burrow or a nest. However, insects tend to get a little trickier. A lot of them are much smaller and you may not be able to immediately spot them. But when you find their hideout, that will make evicting them from your home a lot easier.

Some of the most common signs of insect infestation include:

Infestation Infographic

If you find a nest of insects, do not approach them. You do not know if they are poisonous or prone to biting. For wasps, you may find that the injuries sustained by them may end up forcing you to take a trip to the hospital for treatment. Should you get stung or bitten, you should wrap up the wound and try and pull out any stingers that have been left. They could inflame the wound.

Disinfect the area and wash the area with soap. If you think the sting is bad, you will need to get treatment, especially if you have an allergic reaction to it. Always be careful around insects if you are unsure about whether or not you are allergic to their bites and stings.

Housing disrepairs and infestation facts

Housing Disrepairs: Structural Disrepairs & Insect Infestation

When a structural disrepair occurs on your property, it makes it more likely that an insect infestation will occur. This is due to the fact that the insects will now have access to the inside of your home, or at least a warmer area surrounding it. This makes it more likely that you will experience nests in the roofing, insulation or cracks within your wall. An insect will be more likely to enter your house if you have one of the following disrepairs:

  • Broken Windows
  • Cracked Tiles
  • Smashed Doors
  • Faulty Window Panes

As we are in winter, insects will be looking for shelter. Therefore, if they see sugar in your kitchen, and a broken window that will allow them access into the room, they will infest inside of the room. Therefore, you will need to speak to your landlord about fumigating your house.

How could I be responsible for the infestation

How could I be eligible for compensation from an insect infestation

To be eligible for compensation, your claim needs to fall under at least one of three categories. These are personal injury, damage to belongings and inconvenience. Take a look at the image below to get a better understanding of what the categories are all about:

How to be eligible for Housing Disrepairs Claims

Let’s take a moment to consider how an insect infestation could fall into these types of damages. Personal injuries could occur from bites and stings. If you are allergic to the insects, this could mean you need to go to hospital in order to get treatment. Insects are also very likely to destroy your furniture and clothing by biting it, eating it and using it as nesting.

You may find eggs within your furniture or clothing. So, make sure to check it before you use it. This is an example of damage to belongings. If you are worried about using certain rooms or furniture then this could ruin your daily schedule and quality of life. For instance, you could be scared about going into a certain room because of a wasp’s nest. This is inconvenience. As you can see, an insect infestation can fall into many different types of categories. Make sure you document your evidence of the disrepair, including photographs, videos, witness statements and financial receipts.

Will they be replaced?

Your landlord will have to have the furniture replaced by second-hand alternatives and will have to finance pest control services. They may even need to find you alternative accommodation to make sure that you are safe and sound during the fumigation process.

Your solicitor will be able to look into the disrepairs and have a triage assessor go over to look over the damages. That way your solicitor will be able to focus on helping you claim compensation, whilst your triage assessor will help you get the disrepairs fixed. That means you will have a comfortable house before Christmas arrives!

Housing Disrepairs: What is a Housing Disrepair Claim?

A housing disrepair claim is there to protect you if your council house or house from the housing association is suffering from damages. Unfortunately, as quite a high number of council homes were built in the 1960s and 1980s. This means that that time has left them ailing for repairs.

If asbestos was used, it is also likely to make them very dangerous to live in. Mould and damp is very likely to spread in these types of environment. This is due to the fact that the interiors may not have proper insulation, glazed windows or may just have cracks and breaks that may let in the cold winter air.

Your landlord is expected to help you with any disrepairs that appear in your home. If they fail to do this then they could be guilty of negligence. The only reason they may not help or fund the repair work is if you were responsible for the damages yourself. However, if you were not responsible for the damages, you should expect the following process to take place.

Follow this process:

Housing Disrepairs and how to sort them out

Your landlord will need to respond to your disrepair notice in around a month. If they fail to do so then they could be guilty of negligence. This is due to the fact that they have left the disrepair to get worse. Your landlord could also be guilty of negligence if they have:

  • Acted aggressively towards you
  • Ignored your requests for help
  • Attempted to fix your disrepair cheaply and have put you at risk
  • Inadvertently made the disrepair worse
  • Asked you to pay for the disrepair

Should any of the aforementioned acts of negligence happen to you, you should get in contact with Gowing Law Solicitors to start on your housing disrepair claim. Our lawyers are here to help you and will always provide the best advice in relation to your case. Feel free to ask them any questions that may come to mind.

English Housing Survey and Housing Disrepairs

Mould and Damp Housing Disrepairs: How could they affect my house?

Mould and damp can appear anywhere in your home and is known as the most common of the different housing disrepairs. However it is most likely to be in moist, warm sections of the interior. It is usually in an area that has allowed for condensation to settle on your wall’s surface. This means that the area is damp and can lead to fungus growing on your wall.

There are lots of different types of fungus, however the most dangerous is black mould. Mould can allow for spores to be released that can be inhaled by humans. This is extremely bad for those who suffer from breathing problems, such as asthma.

Condensation is usually allowed to appear on surfaces that are made of plaster, wood or are extremely porous. The surfaces tend to be cold but become damp because it is in a hot or humid environment. Rooms that are mostly affected by mould and damp are those that do not have a very good air flow. It may be tightly packed with furniture or may be a naturally humid due to the essential equipment within the room. If you notice mould in the room, it’s important that you aerate the room as quickly as possible. You should also look into buying mould sprays and cleaning products to stop the mould from spreading.

What sort of housing disrepairs could I experience due to mould?

Due to the fact that mould is a fungus, it can spread to a range of interiors inside your home. This includes your floor, walls, windows, doors and anywhere that contains fabric. Unfortunately, it can cause severe damages to both you and your home. That’s why it’s crucial that you get it sorted as quickly as possible. You can prevent mould by:

  • Using mould sprays and cleaning products
  • Allowing the room to aerate after washes and bathing
  • Opening windows to prevent humidity build up
  • Placing humidifiers in different rooms

Unfortunately, in some cases, the mould and damp may be so severe that it simply cannot be removed without professional intervention. If your mould build-up is bad, you may end up experiencing the following damages in your home:

Mould and Damp Housing Disrepairs Infographic

If you notice any dizziness, hallucinations or confusion, it’s important that you get out of the house as quickly as possible. It’s likely that your home suffers from black mould. This type of mould can be toxic and can cause severe personal injuries. Make sure to get mould in your home seen to as quickly as possible. It may even need a specialized fumigation service in your home to make sure that all of the spores have been destroyed. There is a chance that you could also be allergic to the mould. Make sure to wash your hands if you touch it. That way you will not come out in a rash.

When you try to clean up mould, make sure to wear protective equipment during the process. That way you can protect yourself from any spills or fumes that could affect your sight or internal organs. You should wear goggles, gloves and may even need to wear a mask if you are worried about breathing in fumes from the cleaning process.

Mould and Clothes

What type of furniture in my house can be affected by mould and damp?

Unfortunately, if there is furniture or belongings in the room that has been affected by mould, it’s very likely that they will also be affected. Spores travel between cloth-based and porous materials, this includes:

  • Clothing
  • Blankets
  • Towels
  • Posters
  • Fabric posters
  • Rugs
  • Paint

It’s more likely that you will find mould in warmer areas, such as your kitchen, but also in rooms that are more likely to be moister or damp. For instance, the bathroom or a room with large windows. Be careful when you take out washing and leave it in a confined space. It may end up that the room starts to develop mould. You may also need to check cupboards or items that have been left near to mouldy walls. It is more likely that the mould will spread that way. You can detect mould by the feeling of damp in the room and the smell. You should also look for the dark splodges or discoloration on your wall.

Will cleaning destroy the mould?

Who is vulnerable to mould and damp?

When you move into a council house, it’s important that you are able to relax in it with your family. Of course, you may be moving in by yourself, but if you move in with a large group of people then this could put them at risk. The more people in the room means that it’s likely that to increase the amount of humidity that is inside the room. Therefore, the amount of damp will rise, meaning that there is a potential for mould to grow.

The most vulnerable groups of people that could be affected by mould include:

  • Young children
  • Pensioners
  • People who suffer from chronic illness.

If you notice someone coughing blood, finding it hard to breath or are becoming extremely dizzy, we would recommend that you take them to hospital as quickly as possible. They may have had a bad reaction to the mould and may need medical treatment as quickly as possible. This includes being given anti-biotitic or put on a respirator.

Is my landlord responsible for the mould in my home?

Yes, your landlord is responsible for the mould in your home. When they entered into a contract with you, they became responsible for your safety. This is known as a “duty of care”. Ultimately, they need to make sure that your house is habitable for you and your family. If they fail to do this then they will be liable for your damages and will need to pay for your compensation. If the housing disrepair falls into one of these categories, you could be eligible for compensation:

Housing Disrepair Claims Eligibility

There is a chance that the mould and damp in your home could assist you with claiming compensation within all three categories. Not only could it worsen your asthma, which is a personal injury, but it could damage your belongings, due to it spreading, and could also make certain areas of the house inaccessible, meaning that you are suffering from inconvenience. If you have fallen under any of these categories, it’s time for you to look into housing disrepair claims. After all, you could be eligible to make a claim yourself. That way, you can get your disrepairs sorted and get compensation for any additional damages that you have suffered.

Covid-19 & Halloween Injuries: What should I do to keep safe?

Last year, Halloween was a lot different from what people were used to. The pandemic forced us to keep apart from each other in order to keep vulnerable people safe. This year, whilst the previous rules have been pulled back and people are allowed to meet again, you may still be feeling concerned about the level of Covid-19 around the UK. That’s why we would recommend that you still take precautions if you still are unsure about whether or not you should actually go out for Halloween.

There is no shame in deciding that you are interested in having a night in, instead of going out for Halloween. You can have a lot of fun on your own or with a small group of friends. However, if you decide to go out to celebrate Halloween, we would recommend taking the following precautions.

Precautions include:

  • Always wear a mask when you go to a public venue.
  • Only go with a few friends that are in your personal bubble.
  • Avoid crowded venues.
  • If you have Covid symptoms, stay inside your home and isolate.
  • Try to choose one or two venues to go to. That way you can avoid seeing people outside your bubble.
  • Wear gloves if you can.
  • Use hand gel to avoid the spread of germs.

You do not have to leave your home to celebrate Halloween if you do not want to. We would recommend that you do stay home and enjoy a quiet night in. That way you can avoid spreading Covid-19 and keep the vulnerable people we know and love safe. Do your part during the pandemic to ensure that everyone stays happy and healthy during this difficult period.

Halloween Injuries and Halloween Costumes

Halloween Injuries: How could I get hurt on Halloween night?

If you want to go out and enjoy Halloween, you have every right to do so. Just keep in mind that there is a chance that you could end up suffering from Halloween injuries. No matter what sort of public venue you go to, you could end up hurt due to someone else’s negligence. That’s why it’s up to you to try and keep as safe as possible. In some cases, you simply couldn’t avoid the accident. The venue may have done everything that they could to keep people safe. But in times where accidents do occur, they will have insurance to make sure they can pay for your compensation. This is known as public liability insurance.

One of the most major risks comes from the fact that you will be going out at night. October is a dark month, therefore you may end up finding that you simply cannot see where you are going, especially if you end up getting drunk. Before we go further into common Halloween injuries and accidents, here are some ways that you can remain safe if you decide to go out for Halloween to celebrate.

Keep safe by:

How to keep safe on Halloween

It’s important that you do your best to keep safe when you go out for a Halloween party. When you go to a public environment, the person in charge does have a responsibility to keep you safe. However, you can only make a claim if the person in charge or one of their employees were responsible for your accident. That means if you were the one that was guilty of negligence, and you were hurt due to it, it is likely that you will not be able to claim compensation for it. This is due to the fact that you were responsible for your own behaviour. If you were acting out of line or silly, and this resulted in you getting hurt, you will not be able to claim. However, if the person in charge of the environment was responsible, you can successfully make a claim.

So, make sure to keep safe when you go out for Halloween. The type of negligence you experience will determine how much you could be owed if you end up getting hurt.

No matter what type of event you are going to, it’s crucial that you remain as safe as possible when you are there. Halloween tends to be one of the most accident-prone holidays in the year. This is due to the fact that everyone is going out when it is dark and they are in costumes that are difficult to manoeuvre. You need to be responsible when you arrange fun on Halloween, especially if you plan on going out with your children. Below you can find more information about some of the most common Halloween injuries that can occur, as well as what type of things can cause them. Make sure to keep an eye out for them when you leave your home to celebrate Halloween!

1. Drinking and Driving: Pedestrian Collision Injuries

Pedestrian Accidents on Halloween

One of the most common accidents occurs due to drunk driving on Halloween. It’s pretty easy to understand why. Everyone is going to be out celebrating Halloween by going to bars, parties or some sort of event. Therefore, you are going to get people who break the law and decide to drive back home under the influence of alcohol. This type of accident is a traffic accident, or a RTA for short. Road accidents occur on Halloween because people do not pay attention to the road. This is for both the car driver and the pedestrian who crosses. Unfortunately, on Halloween, road users will need to be more careful when they go out. Pedestrians tend to jump out in the middle of the road instead of looking for a zebra crossing or traffic light system.

Sadly, this causes a lot of injuries, including:

  • Broken Bones
  • Damaged Organs
  • Damaged Nerves
  • Loss of Limbs
  • Loss of Eye Sight
  • Brain Damage

If you are planning on going out for Halloween, take care when you approach a road. Look both ways and ensure that there is a traffic system in place to keep you safe. Unfortunately, there are some drivers (especially drunken drivers) who will not obey the rules of the road or care about pedestrians. They may break the speed limit or be distracted as they are driving by eating, drinking or using their phone.

Should you get hurt due to one of these drunken drivers, it’s important that you seek out medical assistance as quickly as possible. There is a chance that you could be hurt due to a “hit and run.” This is where the car will continue on and leave the pedestrian injured on the street without stopping to help them or leaving them their insurance details. When this happens, you could still make a claim, however it will go under a criminal injuries claim, rather than a RTA claim

No matter what time of the year a traffic accident occurs, you have the right to claim for compensation. Gowing Law Solicitors can assist you with any type of claim.

2. Chemical Burns: Make up and Decorations

Halloween Injuries for Make Up

Another problem that can occur on Halloween is to do with your costumes and make-up. Defective products, such as make up, costumes or decorations, can cause allergic reactions with skin and hair that may mean that you need to go to the hospital to seek assistance. Products and decorations should have ingredients listed upon them, therefore you can make a decision for yourself about whether or not you want to use them. You should also make sure to do a test with the product on your skin to ensure that you will not have an allergic reaction.

Product liability is important when it comes to your safety. You need to ensure that you are okay to use certain products or make up. There are times you may also hang up decorations but they are faulty. If they are electrical, they could cause shocks or fires if the wiring is faulty. You can make a product liability claim if something does break or causes a personal injury. Just keep in mind, if you are making a claim based on an allergic reaction, you will need to be able to prove that you did try out the product and no reaction happened. That way, you can show you were not at fault for the product’s malfunction. You did everything you could to make it safe and a problem still occurred. The manufacturer of the product will then be liable for any damages that you have experienced.

3. Costume Slips and Trips

Halloween Injuries with Costumes

Costumes are one of the best things about Halloween. However, it’s important to understand that they can cause quite a lot of the accidents that occur around Halloween time. A costume that is too long can make it easier for people to trip up and be the victim of broken bones, teeth or foreign bodies that enter the skin (i.e. glass or metal). It may also get wrapped around your body and cause choking or make you more liable to trip over your own feet. Your sight may also be impaired by a mask, veil or eyewear. Therefore, you may bump into things or fall down stairs.

Make sure to be sensible when you pick your costume. That way you can keep safe. Other people may stand on your costume and you may end up bumping into people. This could mean that it is more likely that you could get hurt during the course of the evening. Be careful and make sure that you can see where your feet are. If you cannot see where you are going, make sure you are with a group of people that can guide you around. That way you can feel comfortable that you are with people who can keep an eye on you throughout the night.

4. Drunken Violence

Drinking and Halloween Injuries

Some of the most common types of accidents on Halloween happen due to drunken behaviour. Everyone is relaxing and wants to have a good night. Unfortunately, some people can go wilder than others. Sometimes, people will try to start fights because they are intoxicated. These types of fights can lead to criminal injuries. If you did not start the fight yourself, and ended up getting hurt because of a fight, you could claim compensation. The range of injuries can go from small bruising to more severe injuries, such as organ damage. In some cases, there may even be fatal stabbings.

If you have suffered due to drunken violence, Gowing Law Solicitors can help with your criminal injuries claim. All you need to do is get in contact to learn more about how our law team can help you with your claim.

Gowing Law’s Halloween Pumpkin Carving Competition

We understand that this year, our clients may still be feeling a little nervous about how they are actually going to celebrate Halloween. Some people may be happy to go out and enjoy the night, whilst others may opt for a simpler night in. Therefore, Gowing Law Solicitors is going to go for a classic type of competition this year: A good old-fashioned pumpkin carving competition.

Basically, all you need to do is what you were planning to do to decorate your home. Carving a pumpkin is one of the most essential decorations people do to “spook” up their house. That’s why you should show off your pumpkin carving design in our competition. That way, you could be eligible to win one of these delicious prizes:

What are damages in a personal injury claims case?

Before we give you advice on emotional damages and how you can start working on improving your mental health, let’s have a quick chat about damages in general. There are many different types of damages that you could suffer from if you have become the victim of a public accident. However, the most common damages are known as physical damages. This is when you receive a physical injury due to the negligence of someone else. Your injuries could include:

  • Broken bones
  • External and internal bleeding
  • Fractures and torn muscles
  • Crushed limbs
  • Damaged organs
  • Trauma to the brain or spine
  • Damage to eyesight, hearing or loss of teeth

These are only a few examples of the types of physical damages you could suffer from. If you have suffered from extreme damages that have affected your quality of life, you could be owed a large amount of compensation for your losses. With that said, there are other types of damages that you could claim for. Just keep in mind that you will have to have suffered from a physical injury to claim for these damages.

Different Types of Damages Include:

Emotional Damages and types of damages

As you can see, there are many different types of damages that you can make if you are interested in making a personal injury claim. Gowing Law Solicitors can help you figure out what sort of damages you could claim for. Make sure to let them know as much information as possible about your case. That way they can also give you a rounded estimate about how much you could be owed in compensation. The more details the better your case will be!

Mental health assistance for emotional damages

What are emotional damages in a personal injury claims case all about?

Now that you understand what the basics of damages are all about, let’s take a moment to go through emotional damages properly. After all, they are the type of damages that link specifically to your mental health and your overall quality of life. Emotional damages tend to occur after the physical injury. You may be in a lot of pain and may feel extremely unsure about the future. Worse still, you may feel too scared of other people (such as your medical professionals) who could have let you down in the past.

If you have been hurt, it’s likely that you will start to feel as if your world is closing down. You need to go through a recovery phase. As your body starts to heal, you may find that you get depressed or start struggling with an anxiety disorder. Worse still, if you already a condition that affects your mental health, experiencing an injury can make this worse. Take a look at the example below to get a better idea of how a personal injury could worsen your quality of life and mental health:

Work Accident Injury Case Study for Emotional Damages

As you can see from our case study, Carla was already suffering from a mental health condition. Her injury caused it to get worse as she found it difficult to cope with the recovery period. In fact, she required additional medical attention to help her get through this difficult time. You may have found yourself in a similar situation and feel unsure about what you should do. Of course, you should have your personal injury claim looked at by a legal specialist. They can assess whether or not you require further medical support and can recommend therapies or specialist clinics to help you.

What can emotional damages cover?

It does not matter what type of legal claim you are making; if you have suffered from emotional damages due to your injuries, you should be able to claim for additional compensation. You may have already been struggling with your mental health, especially due to the current pandemic, and your injuries have simply made it worse. That’s why it’s essential that you get help as soon as possible.

Examples of emotional damages/distress include:

  • Insomnia (i.e. a lack of sleep)
  • Anxiety
  • Depression
  • Feelings of humiliation/fear of another person
  • Paranoia/distrust of other people
  • Suicidal feelings/actions

These are only a few examples of the potential emotional damages that you could suffer from. Emotional claims tend to be extremely complicated as they do not have physical evidence that go along with them. However, that doesn’t mean that they can’t cause extreme distress that can leave the victim feeling unsure about their future. Your solicitor can help you organize your case and make sure to do the difficult paperwork for you. That way you can focus on your recovery.

Proving your emotional damages

Mental Health Awareness Week: Be kind to yourself

Mental Health Awareness Week Website

Here at Gowing Law Solicitors, we understand that going through any type of injury can be severely traumatic. We have seen the affect that injuries have on our clients and it can be devastating. Not only can it cause them to lose trust in the people around them, but a lot of their negativity can turn inwards and fester. Worse still, if they have been injured during the pandemic, it’s likely that they will have been finding it more difficult to receive treatment.

Emotional damages can leave scars that cannot be seen, unlike physical damages. But that doesn’t mean that they are not there. It is our responsibility, as solicitors, to ensure that our clients receive support in order to recover. Even if they cannot fully get over their emotional damages, we can still assist anyway we can to ensure that the claim’s process is smooth and easy to follow. That way they can relax and recover whilst we can do the hard work.

With that said, as this week is Mental Health Awareness week, we want to provide some advice about how to take care of yourself if you have suffered from emotional damages. Last year, we provided a small booklet on how to cope with emotional damages after a personal injury claim. However, this year we want to leave our readers with something more digestible. The theme for this year’s mental health awareness week is to get out and enjoy the greenery of the world. We would highly recommend this for our clients if their injuries allow them to do so. However, there are some additional ways you should be taking care of your mental health:

Taking Care of Your Mental Health

Emotional Damages Poster

Take your time when it comes to your recovery. Your mental health is extremely important and it will not get better immediately. Instead, it’s something that you will need to work on. Remember, only you can change your mind-set. However, friends, family, loved-ones and mental health experts will be there to guide you along the way. You will never be alone and will always have someone to go to for advice. That’s why one of the most crucial things you can do is to open up about your feelings. Talking to people, or even seeking an opportunity to open up through counselling, is a great way to voice your concerns and get advice about how to improve yourself. That way you can take your time and feel better in your own time.

It’s time to go outside!

One thing that can help with your emotional damages is taking time to appreciate the little things in life. You have to remember that everyone has been cooped up in their homes for over a year. That’s going to have a severe impact on your mental health, even if you feel as if everything is going reasonably okay. Boredom can leave you lots of time to think and you may start to feel negative thoughts creeping into your mind as time progresses. That’s why we would highly recommend that you do take some time to go outside and meet with people.

If your injuries are severe, this may be difficult, but make sure to do small activities that can make you feel good. Just meeting up with a friend to get some fresh air can do wonders for your mental health. In fact, it may even be a good time to visit a natural park or historical area to make sure you are getting exercise and are seeing some fresh faces.

By connecting with nature, you can appreciate the smaller things in life and slowly start to build up to take back control over your world.

Seek help for emotional damages

Stopping and thinking about the future

It can be daunting knowing that you have to recover from your emotional and physical damages. You never asked to be hurt. That’s why you may be left with a lot of questions that ask “why” you suffered from these damages in the first place. Now, one of the main reasons is that you suffered due to the negligence of someone else. But honestly, there is not solution to the damages in relation to why they happened to you specifically. It may have simply been a case of you were in the wrong place at the wrong time. That’s why it’s important to have a moment of reflection to come to terms with what has happened to you.

It’s okay to take your time with this. Everyone moves on in their own time. You will do the same. Just remember that there are people who are willing to support you and make sure that your recovery process is as easy as possible.

Road Accidents at Easter

Easter Accidents: Keep aware!

Now that we have talked a little bit about our Easter competition and you know how to get involved, we would just like to talk a little about the personal injury accidents that could happen during the Easter holidays. It’s at this time that the weather is getting warmer, and with the lockdown slowly being lessened, it’s important to take precautions in order to keep you and your family safe.

Although it is still advised that you do not go far, it is possible that you could experience a public accident due to someone else’s negligence. For instance, if you go to a store in order to pick up Easter baking supplies, you could be in danger of getting hurt due to:

  • Unstable product shelving
  • Products being messily left on the floor
  • Broken casing
  • Slippy floors
  • Violent customers

If you do get hurt due to someone else’s negligence over the Easter holidays, you could be eligible for compensation. The person in charge of the public venue, be there an employer, local government or a different body of authority, owed you a “duty of care”. That’s why if you got hurt due to their negligence and they did not do everything reasonably possible to help you, you can claim for compensation.

Evidence for a public accident claim

Don’t forget that to have a successful public accident claim, you will need evidence. Take a look at the infographic below for a better idea of what you could use to back up your case:

Personal Injury Evidence Infographic

We know it can feel a bit unsettling to make a claim around the Easter holidays. You want to spend time with your family, friends and loved ones. Even if you can’t leave your home due to the lockdown, it’s still comforting to know that you can make some happy memories with your own personal social bubble. If you do end up getting hurt due to someone else’s negligence, speak with Gowing Law Solicitors today. We can help you get the compensation that you deserve.

National Day of Reflection: How has the lockdown affected our law firm?

National Day of Reflection Header

Today is the UK’s National Day of Reflection. It is funny realizing that an actual year has passed since the lockdown first started. Since then, life for our employees, clients and people all over the world has changed completely. This is a time where we can look back and see how far we have come. We can also take a moment to reflect on the lives of people who we have lost over the previous year. The battle has been a difficult one, but here at Gowing Law, we are confident that there is a light at the end of the tunnel.

On this day, Gowing Law and our team of solicitors are reflecting on the grief that each one of us share. We have lost loved ones, friends and family. The sacrifices we have made over the last year were not in vain. Instead, it is up to us to come together as a community and remain as strong as we can for the sake of those who need us most. Our law firm would like to give thanks to the staff of essential services who have been there for the most vulnerable in their time of need.

Today we will be thinking about them and those who are grieving the loss of loved ones. Life and death are what unite us all as human beings. That’s why it’s important to take a moment to not only reflect on those who have passed, but to reach out to someone who is vulnerable and let them know that they still have people they can lean on during this difficult time.

Gowing Law is here to support you during this difficult time

Here at Gowing Law, we understand that dealing with physical and emotional trauma does not instantly go away. Instead, it takes time to heal and makes you stronger as a result. We want to let our clients know that if you need our support during this difficult time of your life, our experienced solicitors and staff will be here for you. Please feel free to use the link below to get in contact with us:

How has the lockdown affected Gowing Law Solicitors?

It is an odd feeling to have gone circle from when the lockdown first began. There was the assumption that we would return to the office soon. However we have now gone through a full year of working remotely. Last year, this was the time we actually started advertising our PPI tax claims services. Now that April is coming up, and the new tax year is coming in, we are getting more clients that are interested in our PPI tax services. We will always help our clients with their tax claims, however it is funny to reflect on how time has passed throughout the lockdown.

We will say that our law firm has been extremely lucky when it has come to the pandemic and the current lockdown. Our staff have adapted to working from home and are still here to help clients all over the UK with their personal injury claims. It’s been difficult for everyone to get used to their new working environment, but we want to make sure that all our staff are comfortable and are still able to help as many people as possible.

Business Interruption Insurance Claim

Whilst this blog is decided to the UK’s National Day of Reflection, we want to remind our clients that our law firm is trying to take on more Covid-19 related legal cases. Over the last year, businesses have struggled to keep afloat even when they have been told to shut their doors by the UK government. This has meant that companies all over the UK have been falling into debt as they cannot make a profit. Not only does it affect the business owners themselves, but the employees who work for them.

That is why the supreme court has made a new decision about business interruption insurance. You could make a claim against your insurer for damages. Our firm can help you even if you have already been refused by your insurer. An expert solicitor can help you claim money back to help you keep your business afloat. Whilst we do not want to detract from today’s overall message, we would like to remind business owners that Gowing Law Solicitors is here to support you during this difficult time. Get in contact with us. We can help you understand what you could be owed. That way you can put the pay-out to good use for you and your employees.

St Patricks Day: Keeping safe and avoiding personal injuries

St Patricks Day Header

Happy St Patricks Day! Today is a special day for people all over the UK and Ireland where they honour their saint by wearing green. Now, normally on St Patrick’s Day, many people would decide to go out and enjoy some socialization in a pub or a bar with their friends. However, this year things are going to be a bit different. Covid-19 and the current lockdown has ensured that pubs and bars are going to remain shut. In fact, in order to maintain social distancing, and avoid getting in trouble with the law, you are not going to be able to meet up with your friends to drink like you may have previously. As we said, this year the holiday is going to have to be celebrated with caution in mind.

Here at Gowing Law Solicitors, we would highly recommend that you stay in your home and, if you are going to drink, do not drink in excess. If you do, there is a chance that you could get hurt. Did you know that the majority of traffic accidents actually happen on this holiday? Our law firm wants to make sure that you remain safe and abide by the social distancing laws currently in place. If you do get hurt in a public area on St Patrick’s Day, don’t hesitate to contact Gowing Law about a compensation claim. You can call us on 0161 464 4444 or visit our personal injury claim’s page here:

Road Traffic Accidents & St Patricks Day

Did you know that 25,000 pedestrian accidents are actually reported to the police every year? St Patricks Day is notorious for drunk drivers and road traffic accidents. This is due to the drunken celebrations of the holiday. If you are a pedestrian then you are eligible to make a pedestrian traffic claim. Traffic accident claims can be made if the driver, who hurt the pedestrian, neglected their “duty of care” towards the victim. They are responsible for keeping pedestrians, other drivers and passengers safe when they are utilizing the road or sidewalk. It is illegal to drink and drive, but this does not stop people from doing it. If you are the victim of drunk driving then you can make a compensation claim against them.

We would like all of our clients to know that whether you have got injured on a holiday, or on any other day of the year, our solicitors will be here to support you. They can help you collect your evidence and make sure that you get the compensation that you deserve.

Evidence can include:

Although St Patricks Day may be different this year, because there are no pubs and bars to go to, there is a chance that people may end up drinking at home. Therefore, it is important that you are aware that there could be drunken drivers on the road. Make sure to keep an eye on the roads if you are planning on going out. That way if you notice a driver:

  • Breaking the speed limit
  • Being involved in a “hit and run”
  • Driving through red lights
  • Speeding on the wrong side of the road
  • Refusing to stop for pedestrians

You can alert the authorities and also make sure to keep out of their pathway. That way you should be able to stay safe if you go out in the evening, especially on St Patrick’s Day.

What sort of other personal injuries can happen on St Patricks Day?

When we think about personal injuries and St Patricks Day, the first thing that comes to mind are drunk drivers. However, there are several other public accidents that could lead to you making a compensation claim. It’s tradition to bake on St Patrick’s Day, so if you work in a restaurant, it’s likely that you could be getting takeaway orders for people to celebrate the occasion. You could get hurt due to:

  • Kitchen accidents (such as fires or knife accidents)
  • Burns
  • Slips & trips
  • Violent customer altercations

Even during the pandemic, you could still be eligible for compensation if you suffered due to the negligence of your manager or work staff. They should be doing everything within their power to ensure you are safe when you do your job, even during the holiday season, therefore if you can prove that you suffered from their negligence, you could have a successful claim on your hands.

Criminal Injuries & St Patricks Day

Another thing that we would also like to make note of in relation to St Patricks Day are criminal injuries. Now, you should not really be going out this holiday season, however if people do choose to get extremely drunk in the evening time, it is likely that you could become the victim of criminal damages. This could include you becoming involved in a physical altercation or someone invading your home, or damaging your property (and you) in the process. Under the CICA scheme, you could be eligible for compensation. Just make sure to alert the police and allow them to conduct an investigation before you make your claim. That way it will not be invalidated by refusing to get the proper authorities involved.
